New Data Protection Legislation – Data Protection Act 1998, came into force on 1st March 2000, yet research by the Stationery Office indicates that over half of all company directors are unaware of its provisions, despite warnings of possible imprisonment and fines for failure to comply.
The whole Act is a minefield of legislation, as a Data Controller your responsibility is to insure integrity of all information relating to your business and/or employees; alive or dead.
The Data Controller must:-
- Choose a data processor providing sufficient guarantees in respect of the technical and organisational security and measures governing the processing to be carried out.
- Take reasonable steps to ensure compliance with those measures.
In effect the whole process of ensuring data integrity is you and your companies’ responsibility. Failure to do so can quite easily lead to a substantial fine and/or imprisonment. More importantly the irreparable damage to your company’s reputation.
